1099 threshold for 2026: the $2,000 rule, who gets a 1099 and when it's due

Payments you make in 2026 need a Form 1099-NEC or 1099-MISC only once they reach $2,000 for the year, up from $600. Royalties still start at $10, and settlements paid to attorneys at $600. Check a payment below to see which form and box it goes on, or why it doesn't need one, and when the forms you file in early 2027 are due.

Key points

The new threshold
$2,000 per payee for payments made in 2026, on Form 1099-NEC and most boxes of Form 1099-MISC. Through 2025 it was $600. Publication 1099 says the amount will be adjusted for inflation beginning in 2027.
What didn't change
Royalties are reportable from $10, and gross proceeds paid to an attorney, such as a settlement, from $600.
Due in 2027
Form 1099-NEC goes to the payee and the IRS by February 1, 2027. Form 1099-MISC goes to the payee by February 1, 2027 and to the IRS by March 1, 2027 on paper or March 31, 2027 electronically.
Who doesn't get one
Most corporations, your employees (they get a W-2), and anyone you paid by card or through a payment network, which the payment processor reports on Form 1099-K.

  • The 12/2026 Form 1099-NEC moved nonemployee compensation to box 1a and added boxes 1b to 1d for cash tips, tipped occupation codes and qualified overtime included in box 1a.
  • There is no automatic extension of time to file Form 1099-NEC with the IRS.

What changed for 2026

Publication 1099 (2026) states the change directly: for tax years beginning after 2025, the minimum threshold for reporting certain payments on information returns, and for backup withholding on those payments, increased to $2,000, and will be adjusted for inflation beginning in calendar year 2027. Before that, the threshold was $600.

The change came from Public Law 119-21, the tax law enacted in July 2025. It applies to payments made in 2026, which you report on forms filed in early 2027. Forms for 2025 payments, due in early 2026, still used $600.

The form itself changed too. The December 2026 revision of Form 1099-NEC moves nonemployee compensation from box 1 to box 1a and adds boxes 1b to 1d for cash tips, tipped occupation codes and qualified overtime included in box 1a. Form 1099-MISC gains boxes 13a, 13b and 14 for the same items within box 3.

Who gets a 1099

The Instructions for Forms 1099-MISC and 1099-NEC give four conditions for a Form 1099-NEC. All four have to be true:

  1. You paid someone who isn't your employee.
  2. You paid for services in the course of your trade or business. Nonprofits and government agencies count as engaged in a trade or business.
  3. You paid an individual, a partnership or an estate, or in some cases a corporation.
  4. Your payments to that payee for the year totaled at least $2,000.

Whether a payee falls inside the corporate exemption depends on how it's taxed, not on its name. The tax classification box the payee checks on Form W-9 is the place to look.

Do you send a 1099 to an LLC?

Often, yes. The corporate exemption covers an LLC only when it's treated as a C or S corporation. A single-member LLC owned by an individual, or an LLC taxed as a partnership, gets a Form 1099-NEC once you pay it $2,000 or more for services in 2026. An LLC taxed as a corporation generally doesn't, unless you paid it for legal services or medical and health care.

Payments that don't need a 1099 from you

The IRS instructions list payments that don't go on Form 1099-MISC or 1099-NEC, though they may still be taxable to the person who receives them. The ones that come up most for a business:

  • Personal payments. Only payments made in the course of your trade or business are reportable. The plumber who fixes your kitchen at home doesn't get a 1099 from you.
  • Card and payment network payments. Payments made by credit card or other payment card, or through a third-party payment network, are reported on Form 1099-K by the payment settlement entity, and aren't subject to reporting on Form 1099-MISC or 1099-NEC.
  • Goods. Payments for merchandise, telegrams, telephone, freight, storage and similar items.
  • Rent paid through an agent. Rent paid to a real estate agent or property manager. The agent or manager files Form 1099-MISC for the rent it pays over to the owner.
  • Most payments to corporations, including LLCs treated as C or S corporations, apart from the legal and medical exceptions above.
  • Payments to tax-exempt organizations and governments.
  • Wages, which go on Form W-2.
  • Prescription drugs from a pharmacy, and payments to tax-exempt or government-owned hospitals and extended care facilities, which are carved out of medical and health care reporting.

2027 due dates for 2026 payments

Publication 1099 sets the dates, and moves any that fall on a Saturday, Sunday or legal holiday to the next business day. That rule moves three of the usual dates in 2027: January 31, 2027 is a Sunday, February 15, 2027 is Washington's Birthday (Presidents' Day) and February 28, 2027 is a Sunday.

When forms reporting 2026 payments are due
FormTo the payeeTo the IRS
1099‑NECFebruary 1, 2027February 1, 2027, on paper or electronically
1099‑MISCFebruary 1, 2027, or February 16, 2027 if box 8 or 10 has an amountMarch 1, 2027 on paper, March 31, 2027 electronically

The 1099-NEC date is set by law: section 6071(c) requires the form by January 31, on paper or electronically. Form 8809 gets an automatic 30-day extension for most information returns, but Publication 1099 says no automatic extension is available for Forms W-2 and 1099-NEC.

Paper or e-file

If you file 10 or more information returns in total for the year, counting Forms W-2 with the 1099s, you have to file them electronically. The IRS's Information Returns Intake System (IRIS) is a no-cost portal: you can key in forms or upload a .csv file, up to 100 forms per submission, and print the payee copies.

Collect a W-9 before you pay

Form W-9 gives you the payee's legal name, tax classification and taxpayer identification number (TIN). Asking for it before the first payment is easier than chasing it in January, and it decides two things: whether the payee is exempt as a corporation, and whether you have to backup withhold.

  1. Request the W-9 at onboarding

The payee certifies its TIN and classification under penalties of perjury. An attorney has to give you its TIN, though it isn't required to certify it.

  2. Check the name and TIN

Payers who file Forms 1099-MISC and 1099-NEC can match name and TIN combinations against IRS records through the IRS TIN Matching e-service before filing.

  3. Backup withhold if there's no TIN

If the payee doesn't provide a correct TIN, you withhold 24% from reportable payments, report the withholding in box 4 of the form and on Form 945, and file the 1099 whatever the amount. Publication 1099 applies the $2,000 threshold to backup withholding on these payments as well.

  4. Keep copies

Keep copies of the returns you file, or the ability to reconstruct them, for at least 3 years from the due date, or 4 years if you backup withheld.

Penalties for late or wrong 1099s

The IRS charges a penalty for each information return not filed correctly and on time, and a separate penalty for each payee statement not furnished correctly and on time. The amount depends on how late the correct form arrives. For returns and statements due in 2027:

Information return penalties for returns and statements due in 2027
FiledPer return or statementAnnual maximum, small businessAnnual maximum, larger business
Up to 30 days late$60$244,500$698,500
31 days late through August 1$130$698,500$2,095,500
After August 1, or not filed$340$1,397,000$4,191,500
Intentional disregard$690No maximumNo maximum

A small business, for these maximums, is one with average annual gross receipts of $5 million or less over the 3 most recent tax years. The IRS may remove or reduce a penalty if you acted in good faith and can show reasonable cause.

A 1099 checklist for January 2027

Forms 1099-NEC and 1099-MISC for 2026 payments

  • Export the year's vendor payments from accounts payable, and set aside those made by card or through a payment network.
  • Total the rest by payee and payment type, and flag payees at $2,000 or more for services, rent, prizes or medical care, $10 or more in royalties, and $600 or more in gross proceeds to an attorney.
  • Match each flagged payee to a Form W-9, and drop corporations unless the payments were for legal or medical services.
  • Request missing W-9s, and run names and TINs through IRS TIN Matching.
  • Count all your information returns, W-2s included. At 10 or more, plan to e-file.
  • Send Form 1099-NEC to payees and file it with the IRS by February 1, 2027.
  • Send Form 1099-MISC to payees by February 1, 2027 (February 16, 2027 for box 8 or 10), and file it by March 1, 2027 on paper or March 31, 2027 electronically.
  • Save copies and the payment detail behind them.

The same step sits in the year-end close checklist, with the rest of the work that closes out the year.

1099 threshold 2026: questions

Is the 1099 threshold $600 or $2,000?
$2,000 for payments made in 2026, for Form 1099-NEC and most boxes of Form 1099-MISC. Payments made in 2025 used $600. Royalties start at $10 and gross proceeds paid to an attorney at $600 in both years.
Is the threshold per payment or for the year?
For the year, per payee. Add up what you paid the same payee during the calendar year for the same kind of payment, and file once the total reaches $2,000.
Do you send a 1099 to an LLC?
It depends on how the LLC is taxed. A single-member LLC owned by an individual, or an LLC taxed as a partnership, gets a Form 1099-NEC for $2,000 or more in services. An LLC taxed as a C or S corporation generally doesn't, unless the payments were for legal services or medical and health care. The payee's Form W-9 shows its classification.
Do I send a 1099 to a contractor I paid by credit card or a payment app?
Not for those payments. Payments made by card or through a third-party payment network are reported on Form 1099-K by the payment settlement entity, not by you on Form 1099-NEC. Payments you made by check, ACH, wire or cash are yours to report.
When are 1099s due in 2027?
Form 1099-NEC is due to payees and the IRS by February 1, 2027, because January 31, 2027 is a Sunday. Form 1099-MISC is due to payees by February 1, 2027 (February 16, 2027 if box 8 or 10 has an amount) and to the IRS by March 1, 2027 on paper or March 31, 2027 electronically.
I paid a contractor $1,500 in 2026. Do I file anything?
Not a Form 1099-NEC, unless you backup withheld from the payments. The contractor still reports the income on their own return: the IRS instructions note that payments you don't have to report may still be taxable to the person who received them.
Can I get an extension for Form 1099-NEC?
Not an automatic one. Form 8809 gives an automatic 30-day extension for most information returns, but Publication 1099 says no automatic extension is available for Forms W-2 and 1099-NEC.
What is the penalty for filing a 1099 late?
For returns due in 2027: $60 per return if the correct return is filed within 30 days, $130 if filed later but by August 1, and $340 after that or if it's never filed, with a separate penalty for each payee statement. Intentional disregard is $690 per return, with no annual maximum.
Will the threshold change for 2027?
Publication 1099 says the $2,000 threshold will be adjusted for inflation beginning in calendar year 2027. The IRS hadn't published the 2027 amount when this page was reviewed; it will be added here when it does.
